Georgia College's Bequest Language

An excellent way for you to support Georgia College's mission is to leave us a Gift in Your Will, living trust or with a codicil. One significant benefit of making a gift by Gift in Your Will is that it allows you to continue to use the property you will leave to charity during your life. Another benefit is that you are able to leave a lasting legacy.

Types of Bequests


There are a number of ways you can make a Gift in Your Will to the Georgia College & State University Foundation.

Specific Gift in Your Will. A specific Gift in Your Will involves making a gift of a specific asset such as real estate, a car, other property or a gift for a specific dollar amount. For example, you may wish to leave your home or $10,000 to the Georgia College & State University Foundation.

Percentage Gift in Your Will. Another kind of specific Gift in Your Will involves leaving a specific percentage of your overall estate to charity. For example, you may wish to leave 10% of your estate to the Georgia College & State University Foundation.

Residual Gift in Your Will. A residual Gift in Your Will is made from the balance of an estate after the will or trust has given away each of the specific Gifts in Your Will. A common residual Gift in Your Will involves leaving a percentage of the residue of the estate to charity. For example, you may wish to leave 30% of the residue of your estate to the Georgia College & State University Foundation.

Contingent Gift in Your Will. A contingent Gift in Your Will is made to charity only if the purpose of the primary Gift in Your Will cannot be met. For example, you could leave specific property, such as a vacation home, to a relative, but the Gift in Your Will language could provide that if the relative is not alive at the time of your death, the vacation home will go to the Georgia College & State University Foundation.

Retirement Plan Beneficiary Language You may name the Georgia College & State University Foundation as a beneficiary of your IRA or other qualified retirement benefits. Donors should consult with their tax advisor regarding the tax benefits of such gifts. Naming the Georgia College Foundation as the beneficiary of a qualified retirement plan asset such as a 401(k), 403(b), IRA, Keogh or profit-sharing pension plan will accomplish a charitable goal while realizing significant tax savings. It can be costly to pass such assets on to heirs because of heavy tax consequences. By naming the Georgia College Foundation as a beneficiary of a retirement plan, the donor maintains complete control over the asset while living, but at the donor's death the plan passes to support Georgia College free of both estate and income taxes. Making a charitable gift from your retirement plan is easy and should not cost you any attorney fees. Simply request a change of beneficiary form from your plan administrator. When you are done, please return the form to your plan administrator and notify Georgia College. We can also assist you with the proper language for your beneficiary designation to the Georgia College Foundation.

Gift in Your Will Benefits


A Gift in Your Will is generally a revocable gift, which means it can be changed or modified at any time. You can choose to designate that a Gift in Your Will be used for a general or specific purpose so you have the peace of mind knowing that your gift will be used as intended. Gifts in Your Will are exempt from federal estate taxes. If you have a taxable estate, the estate tax charitable deduction may offset or eliminate estate taxes, resulting in a larger inheritance for your heirs.

In order to make a Gift in Your Will, you should speak with your attorney. Your attorney can help you include a Gift in Your Will to the Georgia College & State University Foundation in your estate plan. We have provided some basic Gift in Your Will language to assist you and your attorney.

1. Specific Gift in Your Will

If you are considering making an outright Gift in Your Will to the Georgia College & State University Foundation, we recommend the following language:

Gift in Your Will of a Specific Dollar Amount

I hereby give, devise and bequeath _________ and No/100 dollars ($DOLLARS) to the Georgia College & State University Foundation, a nonprofit organization located at Campus Box 96, Milledgeville, GA, 31061, Federal Tax ID #58-6043972, for Georgia College's general support, or for the support of a specific fund or program.

Gift in Your Will of Specific Personal Property

I hereby give, devise and bequeath DESCRIPTION OF PROPERTY to the Georgia College & State University Foundation, a nonprofit organization located at Campus Box 96, Milledgeville, GA, 31061, Federal Tax ID #58-6043972, for Georgia College's general support, or for the support of a specific fund or program.

Gift in Your Will of Specific Real Estate

I hereby give, devise and bequeath all of the right, title and interest in and to the real estate located at ADDRESS OR DESCRIPTION OF PROPERTY to the Georgia College & State University Foundation, a nonprofit organization located at Campus Box 96, Milledgeville, GA, 31061, Federal Tax ID #58-6043972, for Georgia College's general support, or for the support of a specific fund or program.

2. Percentage Gift in Your Will

If you are considering making a Gift in Your Will of a percentage of your estate to the Georgia College & State University Foundation, we recommend the following language:

I hereby give, devise and bequeath ____ percent (___%) of my total estate, determined as of the date of my death, to the Georgia College & State University Foundation, a nonprofit organization located at Campus Box 96, Milledgeville, GA, 31061, Federal Tax ID #58-6043972, for Georgia College's general support, or for the support of a specific fund or program.

3. Residual Gift in Your Will

I hereby give, devise and bequeath to the Georgia College & State University Foundation, a nonprofit organization located at Campus Box 96, Milledgeville, GA, 31061, Federal Tax ID #58-6043972, ALL OR A PERCENTAGE of the rest, residue and remainder of my estate to be used for Georgia College's general support, or for the support of a specific fund or program.

4. Contingent Gift in Your Will

If (primary beneficiary) does not survive me, then I hereby give, devise and bequeath to the Georgia College & State University Foundation, a nonprofit organization located at Campus Box 96, Milledgeville, GA, 31061, Federal Tax ID #58-6043972, DESCRIPTION OF PROPERTY to be used for Georgia College's general support, or for the support of a specific fund or program.

Restricted Gifts in Your Will


If you are considering a Gift in Your Will but would like to ensure that your Gift be used for a specific purpose, please let us know. We would be happy to work with you and your attorney to help you identify ways to give and meet your charitable objectives. We will also work with you and your attorney to craft language to accomplish your goals.

If you are making a restricted Gift in Your Will, we recommend that your attorney include the following provision to give Georgia College flexibility should it no longer be possible for Georgia College to use your gift as you originally intended:

If, in the judgment of the Board of Directors of the Georgia College & State University Foundation, it shall become impossible for the Georgia College & State University Foundation to use this Gift in Your Will to accomplish the specific purposes of this Gift, Georgia College may use the income and principal of this gift for such purpose or purposes as the Board determines is most closely related to the restricted purpose of my Gift in Your Will.
